Lux4life.eu is a brand of PROINTEGRUM GROUP Sp. z o.o.
(2) Any differing terms and conditions of the customer shall not apply unless we have expressly agreed to them. Mandatory statutory provisions applicable to consumers remain unaffected.
(3) A consumer is a natural person entering into a legal transaction for purposes which are predominantly outside that person's trade, business or profession.
(4) An entrepreneur is a natural or legal person or an organisation with legal capacity acting for purposes relating to its trade, business or professional activity.
(5) Where Polish law extends individual consumer protection provisions to natural persons concluding a contract directly connected with their business activity but not of a professional nature for them, the corresponding protection shall also apply.
§ 2 Electronic services and technical requirements
(1) Lux4life.eu provides, in particular, the following electronic services:
- access to and use of the online shop,
- product search and display of product information,
- electronic shopping cart and ordering process,
- where available, creation and use of a customer account,
- electronic means of contacting us.
(2) Use of the online shop requires an internet-enabled device, current web-browser software, internet access and, where required for ordering or communication, a valid e-mail address.
(3) Certain functions may require technically necessary cookies or comparable technologies. Further information can be found in the privacy policy and cookie settings.
(4) Customers may not submit unlawful content through the shop or use the technical infrastructure in a manner that compromises its security or functionality.
(5) Agreements concerning free electronic shop services may generally be terminated at any time by ceasing to use them. Where a customer account is available, its deletion may be requested unless statutory retention obligations prevent complete deletion.
§ 3 Subject matter and conclusion of the contract
(1) Contracts concluded through Lux4life.eu primarily concern the sale of goods.
(2) Product presentations in the online shop do not normally constitute a legally binding offer but an invitation to the customer to submit an order.
(3) Customers can place selected goods in the shopping cart. Before submitting the order, they can change products and quantities, remove items and correct their entries.
(4) During checkout, customers are shown in particular the selected goods, prices, applicable taxes where relevant, shipping costs, delivery information and available payment methods.
(5) By clicking the final order button clearly indicating that the order entails an obligation to pay, the customer submits a binding offer to purchase the goods contained in the shopping cart.
(6) An automatically generated acknowledgement of receipt merely confirms that the order has been technically received. It does not constitute acceptance unless expressly stated otherwise.
(7) The contract is concluded when we expressly accept the order, confirm dispatch or dispatch the goods, whichever occurs first.
(8) If an ordered product unexpectedly becomes unavailable and the order cannot therefore be accepted, the customer will be informed without undue delay. Payments already made will be refunded without undue delay. Statutory rights remain unaffected.
(9) Individual offers made outside the automated ordering system are binding for the period stated in the offer. If no period is specified, the offer may be accepted within five days.
§ 4 Prices, taxes and payment
(1) Prices displayed to consumers include the VAT applicable to the selected country of delivery and transaction, insofar as VAT is due.
(2) Any additional shipping costs are displayed before the customer submits the binding order.
(3) Available payment methods are displayed during checkout. The customer has no entitlement to a particular payment method.
(4) Unless otherwise stated for the selected payment method, payment becomes due immediately upon conclusion of the contract.
(5) Where third-party payment providers are used, their additional terms may apply insofar as these are made available to the customer before or during payment.
(6) Cross-border B2B supplies may be subject to different VAT treatment where the statutory requirements are met.
§ 5 Delivery and shipping
(1) Available delivery areas, shipping methods, shipping costs and expected delivery times are stated in the online shop or the respective offer.
(2) Orders may be fulfilled by manufacturers, suppliers, logistics providers or other parties commissioned by us. Even where goods are shipped directly by such a partner, PROINTEGRUM GROUP Sp. z o.o. remains the customer's contractual partner. The involvement of a shipping or dropshipping partner does not restrict statutory customer rights.
(3) Goods from one order may be shipped from different warehouses and delivered in separate consignments. No additional shipping costs will arise unless expressly agreed before the order is placed.
(4) For consumers, the risk of accidental loss or deterioration generally passes only when the goods are handed over to the consumer or a third party designated by the consumer. This does not apply where the consumer independently commissions a carrier not offered by us.
(5) For entrepreneurs, the statutory provisions of the applicable law govern transfer of risk and transport.
§ 6 Retention of title
The goods remain our property until the purchase price has been paid in full, insofar as permitted under the applicable law.
§ 7 Consumer right of withdrawal
(1) Consumers generally have a statutory right of withdrawal from distance contracts.
(2) Details concerning the period, exercise, consequences, return of goods and statutory exceptions are set out in our separate Withdrawal Policy, including the model withdrawal form.
(3) These Terms and Conditions do not restrict statutory withdrawal rights.
§ 8 Conformity of goods, defects and complaints
(1) Statutory provisions concerning conformity of goods apply to consumers. We are responsible for lack of conformity where the statutory requirements are met.
(2) In the event of non-conformity, consumers may in particular have statutory rights to repair or replacement and, subject to the applicable requirements, price reduction or termination of the contract.
(3) Statutory rights are not restricted by any additional manufacturer or seller guarantee.
(4) Complaints may be submitted by e-mail to info@lux4life.eu. To facilitate processing, customers should, where possible, provide the order number, a description of the issue and appropriate evidence. Failure to provide such additional information does not exclude statutory rights.
(5) Consumers are not required to report visible transport damage to the carrier in order to preserve their statutory claims against us. Prompt notification may nevertheless facilitate processing and claims against the carrier.
(6) For entrepreneurs, the relevant provisions of Polish law apply unless otherwise effectively agreed in an individual case.
§ 9 Guarantees
(1) An additional guarantee exists only where expressly stated for the respective product.
(2) Where a manufacturer provides a guarantee, its scope, duration and conditions are governed by the respective guarantee statement.
(3) Statutory claims against us as seller remain unaffected by any additional guarantee.
§ 10 Liability
(1) In relation to consumers, we are liable in accordance with mandatory statutory provisions.
(2) Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be prohibited by mandatory law.
(3) The use of suppliers, manufacturers, fulfilment providers or carriers does not remove our statutory responsibility towards the customer.
§ 11 Contract language and storage of contract information
(1) For orders placed through the English-language version of Lux4life.eu, the contract language is English.
(2) For orders placed through another language version, the language used during that ordering process generally constitutes the contract language.
(3) The version of these Terms and Conditions provided for the respective language market applies to the contract concluded in that language.
(4) Order information is stored as required by law and technical necessity. The customer receives essential order and contractual information on a durable medium, in particular by e-mail.
(5) Before submitting an order, customers may save or print the displayed information using their browser functions.
§ 12 Applicable law
(1) Contractual relationships between the customer and PROINTEGRUM GROUP Sp. z o.o. are generally governed by the law of the Republic of Poland.
(2) Where the customer is a consumer habitually resident in another country, this choice of law does not deprive the consumer of the protection afforded by mandatory provisions of the law which would apply in the absence of this choice.
(3) The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded insofar as legally permissible.
§ 13 Jurisdiction
(1) Mandatory statutory provisions concerning international and local jurisdiction apply to consumers. These Terms and Conditions do not require consumers to bring disputes exclusively before courts in Poland where mandatory law provides otherwise.
(2) In relation to entrepreneurs, and insofar as such an agreement is legally permissible, the registered office of PROINTEGRUM GROUP Sp. z o.o. in Poland shall be the place of jurisdiction for disputes arising from the business relationship.
§ 14 Alternative dispute resolution
Consumers may use available alternative dispute resolution procedures in accordance with the applicable statutory provisions. Information concerning competent or available bodies will be provided where legally required.
§ 15 Amendments and final provisions
(1) A completed purchase contract is generally governed by the version of these Terms and Conditions incorporated into the contract at the time of the order.
(2) If any provision is or becomes wholly or partly ineffective, mandatory statutory provisions and the validity of the remaining provisions remain unaffected.
(3) Any additional mandatory consumer rights under applicable national or European law remain unaffected.
